Propitas have recently completed a portfolio of Dilapidation Assessment Reports for a Highways Contractor who is appointed on a framework contract in the South of England. The Highways Depots that we inspected were found to be showing their age (as is typical for property of this type). These highway maintenance contracts typically impose a relatively limited repairing obligation on such tenants, with leases usually being restricted by Schedules of Condition as well as a lack of redecorating covenant. In this particular case, the Schedules of Condition were of such poor quality as to be almost worthless. Our defence of the landlord’s claim will likely be more dependent on other alternative approaches that we can develop on behalf of our client.
